Terms of Service

Effective Date: January 1, 2024

By booking a photography session or engaging the services of Gabriel Pfeiffer Photography ("Photographer"), the client ("Client") agrees to the following terms and conditions:

1. Ownership of Images
All images, including but not limited to digital photographs, prints, and negatives, taken by Gabriel Pfeiffer Photography during any photography session are the sole property of the Photographer. The Photographer retains full rights to use, edit, reproduce, and sell the images in any form, including but not limited to:

Print media (books, prints, posters, etc.)
Online platforms (websites, blogs, social media, etc.)
Advertising, marketing, or promotional materials
Commercial and editorial purposes

2. Client Usage Rights
The Client is granted a non-exclusive, non-transferable license for personal use of the images provided by the Photographer. This includes sharing images for personal use on social media, personal websites, or in personal print albums. However, the Client agrees not to sell, edit, or otherwise use the images for commercial purposes without express written permission from the Photographer.

3. Social Media and Online Usage
The Photographer retains the right to use images for social media and internet use, including but not limited to:

Posting on the Photographer's social media accounts (Instagram, Facebook, etc.)
Displaying images on the Photographer’s website or portfolio
Featuring images in online publications, blogs, and other media

4. Commercial Use
The Photographer reserves the right to sell images captured during any session to third parties for commercial purposes, including but not limited to stock photography, print sales, and licensing agreements.

5. Model Release
By booking a photography session, the Client and all participants in the session grant the Photographer and their representatives the right to use their likeness in the images for any legal purposes, including but not limited to advertising, commercial use, or artistic displays. No compensation will be provided to the Client for the use of their likeness in such cases.

6. Image Editing and Retouching
The Photographer retains the exclusive right to edit and retouch all images as they see fit. The Client may not edit, alter, or manipulate the images provided by the Photographer in any way, including adding filters, cropping, or applying modifications.

7. Image Delivery
The Photographer will deliver high-resolution digital files to the Client based on the package agreed upon. Delivery time may vary depending on the nature of the project, but the standard delivery period is 2-4 weeks. Physical prints or albums are not included unless specifically noted in the contract or package agreement.

8. Liability
Gabriel Pfeiffer Photography is not responsible for any damages, losses, or claims arising from the use of the images by third parties. Once images are delivered to the Client, the Photographer is not liable for unauthorized use of the images by the Client or others.

9. Cancellation and Rescheduling
Cancellations made less than 48 hours before the scheduled session are subject to a cancellation fee of 50% of service charge. The Photographer reserves the right to reschedule sessions due to inclement weather, illness, or other circumstances beyond their control.

10. Payment Terms
A non-refundable deposit of $50.00 is required to secure the session date. Full payment is due by the day of the session. If payment is not made by the agreed-upon date, the Photographer reserves the right to withhold image delivery.

11. Confidentiality
The Photographer may keep certain details of the Client’s session confidential upon request. However, this must be explicitly agreed upon in writing before the session begins.

12. Agreement Changes
Gabriel Pfeiffer Photography reserves the right to modify these terms of service at any time without prior notice. The updated terms will be made available on the Photographer’s website and will apply to all future bookings.

13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New Mexico or the jurisdiction of the photography location(s).

By engaging the services of Gabriel Pfeiffer Photography, the Client acknowledges that they have read, understood, and agree to all terms and conditions listed above.
